Gravity Mobile Inc., a Delaware corporation ("Gravity", "we" or "us") wants to bring you the best music application on the market. To be able to do this, Gravity may request some information from you and automatically collect information about your use of the Gravity Mobile HABU application. We may also request information about your account with third party services, such as 7Digital, Facebook and Twitter. This policy (the "Gravity Mobile Privacy Policy") describes our privacy practices, what personal information we may collect from you and what may be done with your personal information.
If you register with Gravity, the information you supply about yourself ("Personal Data") may be used by Gravity to communicate with you and to provide services to you, like music recommendations. Examples of this Personal Data may be your name, email address and age, along with information about you contained on third-party sites with which the application connects, such as Facebook and Twitter. Gravity will not share your name, email address, or other personally identifying information with other companies. However, Gravity may disclose your Personal Data in response to legal proceedings, or as otherwise required to comply with the law; to protect the rights or property of Gravity or our customers; when Gravity has a good faith belief that disclosure is required to protect the safety of a person; or to a successor in interest to Gravity (including but not limited to an acquisition by or merger with another company).
We may conduct research on our end users’ demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregated data with our affiliates, agents and business partners. This aggregate information does not identify you personally. We may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.
When you utilize the Gravity application, we may receive certain personally non-identifiable information about your use of the Gravity application. Examples may be: your time spent in the application, the number of songs you played while using the application, your device operating system and similar data. Such information, which may be collected passively using various technologies, cannot presently be used to specifically identify you. We may store such information ourselves or it may be included in databases owned and maintained by our affiliates, agents or service providers. We may use such information and pool it with other information to track, for example, the total number of users of the Gravity application. Gravity may share non-identifying information with advertisers and other third parties to improve the relevance of the content provided by those third parties. It is important to note that no Personal Data is available or used in this process.
When you use the Gravity application, your mobile device supplies a unique identifier, which we use to associate certain data (such as music listening history) with your device. For certain location-based features of the Gravity application, we may use location information provided by your device, which you can choose to turn off. To provide these location-based features, Gravity and our partners and licensees may collect, use and share precise location data, including the real-time geographic location of your mobile device. For some third-party partners, such as Facebook, this information will be shared automatically unless you explicitly turn off features designed to collect location-based information. If you choose to use some location-related features, such as sharing "Mood Maps" via email and Facebook, your location data may be disclosed to any party who receives and/or views the Mood Map.
If you have connected the Gravity application to third-party service providers (such as Facebook and/or Twitter), and have agreed to share information with these third parties, Gravity will share such information. For example, Gravity may share which songs you have identified and/or listened to, location data relating to listening and/or recognition activity, which songs you have "Liked," and so forth. Information shared with third parties will be attributed to the third parties’ account to which the Gravity application is connected. The third parties’ use of such information is governed by the third parties’ privacy policies, while this Gravity Privacy Policy governs Gravity’s use of such information. You understand and agree that you need to consult all applicable privacy policies to amend or delete personal information that has been provided to third parties. If you do not wish for such use of your personal data to take place, you should not agree to share information about the music you play with third parties and/or adjust your settings to deactivate such sharing.
The Gravity application is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 years of age. If you are under 13 years of age you should not use the Gravity application, and under no circumstances should you provide personal information to us. If we discover that a child under the age of 13 has provided us with personal information, we will immediately delete that child´s information from our records.
At times it may be necessary for us to make changes to this Privacy Policy; therefore, we reserve the right to update or modify this Privacy Policy at any time and from time to time without prior notice. Please review this policy periodically, and especially before you provide any Personal Data. This Privacy Policy was last updated on the date indicated above. Your continued use of the Services after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
